1) List two primary differences between retributive justice and restorative justice.


  1. Problem definition: retributive justice defines the problem as one between the "state" and the suspect, while restorative justice defines the issue or problem as impacting the victim, the community and the suspect.

  2. Context: the retributive justice system defines the problems and issues very narrowly, while restorative justice defines the issues in a much broader societal context.

  3. Process: the retributive justice system defines the system as adversarial, authoritarian, technical, and impersonal, while restorative justice defines the process as participatory, maximizing information, dialogue and mutual agreement.

2) What are the roles of the victim, community and offender in restorative justice?


The parties participate in the decision as to who committed the wrong or offense and how the offender is to be held accountable. Each are recognized as important participants in the process, but with different needs. The victim and the community needs to be restored and the offender needs to be held accountable and restored back into the community.
